Recruitment and Promotion
1.Recruitment Rules
1.1 The Council, with the prior approval of the Central Government, shall prepare and publish Schedules of Recruitment Rules for various posts or grades, as specified in Schedule – 4 of these Regulations.
1.2 Such Schedules of Recruitment Rules may be revised from time to time with the previous concurrence of the Central Government.
1.3 Each Schedule of Recruitment Rules may, inter alia, contain the following details:
- Name of the Post
- Number of Posts
- Classification of the Posts (e.g., Group A, B, C)
- Scale of Pay
- Whether the post isSelection or Non-Selection
- Age limit for direct recruitment
- Educational and professional qualifications required for the post
- Necessary qualifications for promotion
- Period of probation
- Composition of the Departmental Promotion Committee (DPC)
2.Probation
2.1 Every person appointed to a post under the Recruitment Rules, whether by direct recruitment, promotion, or deputation, shall serve a probationary period as specified against that post in the Schedule.
2.2 Where the appointment itself is for a fixed period as mentioned in the appointment order, such appointment shall terminate on expiry of the period unless extended by the Competent Authority.
2.3 The probation period may, at the discretion of the Competent Authority, be extended for a specified duration, provided that the total extension period shall not exceed one year, except where an extension is necessary due to pending departmental or legal proceedings against the employee.
2.4 An employee may appeal against an order of extension of probation to the Competent Authority.
2.5 During probation, employees may be required to undergo departmental training and qualify in departmental tests as specified by the Competent Authority from time to time.
3.Confirmation of Employees on Probation
3.1 An employee appointed on probation to any entry-grade or post shall be eligible for confirmation:
- Upon successful completion of probation to the satisfaction of the Competent Authority, and/or
- Upon passing any specified departmental tests, if applicable.
3.2 Until confirmed, an employee on probation shall retain the status of a probationary employee.
3.3 In cases of promotion, where a specific probation period is prescribed, the employee must complete probation satisfactorily before confirmation.
4.Discharge or Reversion of Employees on Probation
4.1 An employee on probation with no lien on any post may be discharged at any time without notice if:
- Performance or conduct during probation is deemed unsatisfactory , or
- The Competent Authority receives information regarding nationality, age, health, qualifications, or antecedents, and is satisfied of ineligibility or unsuitability for service.
4.2 An employee on probation who holds a lien on a post may be reverted to that post under the circumstances specified above.
4.3 If an employee is not considered suitable for confirmation at the end of the probation period, they shall be discharged or reverted as per the relevant sub-regulations.
5.Seniority
5.1 The inter-se seniority of personnel appointed to a grade or post shall be determined and regulated according to orders issued from time to time by the Central Government.
6.Reservation
6.1 Orders issued by the Central Government regarding:
- Percentage of reservation
- Rosters
- De-reservation and carry forward
- Relaxations, concessions, and other related matters
…whether by direct recruitment, promotion, or any other mode of appointment, in favour of Scheduled Castes, Scheduled Tribes, Other Backward Classes, Ex-Servicemen, Physically Handicapped persons, and other special categories shall mutatis mutandis apply to all appointments under these Regulations.
